"I Think it is illegal," said Mike Lamb, energy manager in U.S. DOE's office of Energy Efficiency and Renewable Energy Network Clearing House. "I believe that any merchandise imported into the USA has to conform to U.S. standards. That goes with any item."

The Environmental Protection Agency and the DOE agreed. John Flowers, environmental engineer to the EPA, told CONTRACTOR he believes the action close to the Great Lakes is prohibited.

"Any Product coated in the 1992 EPAct, be it plumbing fixtures or light fittings or anything else, even if tried to be imported into the USA shall be refused admission. There's a portion of the EPAct that manages importation. It may be hard to find, but it's in there," Flowers said.

Flowers Said that he was 99% convinced that the flushing toilet smuggling was contrary to the law. "However, it sure smacks of prohibited action to me" Numerous governmental departments have jurisdiction within the EPAct, he added, such as the U.S. Treasury.
